Terms and Conditions of Use

1. Introduction

Welcome to Teachers International Consultancy Ltd (TIC Recruitment). TIC Recruitment is a modern online recruitment platform that supports international schools in the placement of teachers and senior leaders.

These Terms and Conditions (Terms) govern your access to and use of the TIC Recruitment website, platform, and related services (Platform). By accessing or using the Platform, creating an account, or submitting information, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Platform.

In these Terms, “TIC Recruitment”, “we”, “our” or “us” refers to Teachers International Consultancy Ltd, a company registered in New Zealand (NZBN 9429051009328). “You” or “User” refers to any individual or organisation using the Platform, including teachers, senior leaders, and schools.

2. Definitions

In these Terms, unless the context otherwise requires:

Candidate means any teacher or senior leader who registers an account on the Platform.

School means any international school or educational organisation using the Platform to advertise roles or search for Candidates.

Platform means the TIC Recruitment website, databases, and all associated online services.

Subscription means any paid or free subscription option offered by TIC Recruitment to Candidates or Schools.

User Data means all information, including personal information, uploaded to or generated through use of the Platform.

Role means any teaching or leadership position advertised or discussed through the Platform.

2. Nature of the Service

TIC Recruitment provides an introductory and facilitation service only. The Platform enables:

Teachers and senior leaders (Candidates) to register, maintain profiles, and apply for roles; and

International schools and educational organisations (Schools) to advertise vacancies and identify suitable Candidates.

TIC Recruitment is not an employer, employment agency, or party to any employment, consultancy, or contractual relationship formed between a Candidate and a School.

3. Safeguarding, Background Checks & Child Protection

a) TIC Recruitment is committed to safeguarding and child protection and supports international best practice in safer recruitment.

b) As part of our recruitment processes, TIC Recruitment may conduct background checks, reference checks, identity verification, and other due diligence appropriate to the role and jurisdiction.

c) Schools are independently responsible for conducting their own background checks, safeguarding checks, and compliance procedures (including police checks, child protection clearances, and regulatory registrations) in accordance with their local laws and safeguarding policies.

d) TIC Recruitment does not guarantee the suitability of any Candidate and makes no representation that all risks can be eliminated through background or reference checks.

4. Registration and Accounts

4.1 Candidate Accounts

a) Candidates must be at least 18 years of age to register and must hold a recognised teaching qualification from an accredited or recognised tertiary institution.

b) Candidates must provide accurate, current, and complete information, including qualifications, registrations, employment history, and referees.

c) Candidates are responsible for maintaining the accuracy of their profiles and for keeping login details secure.

4.2 School Accounts

a) Schools must ensure that all information provided about vacancies, roles, and employment conditions is accurate and lawful.

b) Schools are responsible for ensuring compliance with employment, immigration, safeguarding, and anti-discrimination laws in their jurisdiction.

5. Confidentiality, Privacy & Data Protection

a) TIC Recruitment collects, stores, uses, and discloses personal information in accordance with the New Zealand Privacy Act 2020 and our Privacy Policy.

b) Candidate data is held securely and confidentially by TIC Recruitment. Reasonable technical and organisational safeguards are used to protect personal information from loss, misuse, unauthorised access, or disclosure.

c) Candidate information will only be shared with Schools where:

the Candidate has applied for a Role; and

the Candidate is being actively considered or shortlisted for that Role.

d) TIC Recruitment does not sell Candidate data or disclose it to third parties for unrelated marketing purposes.

e) Candidates have the right to request access to, correction of, or deletion of their personal information, subject to legal and operational requirements under the Privacy Act 2020.

6. Relationship Between Users

a) Any employment relationship, offer, appointment, or engagement is strictly between the Candidate and the School.

b) TIC Recruitment is not responsible for negotiations, contracts, salaries, benefits, visas, relocation arrangements, or workplace conditions.

c) Users agree not to do anything that may bring TIC Recruitment or another User into disrepute.

7. Platform Use and Conduct

Users must not:

provide false or misleading information;

misuse or attempt to interfere with the Platform;

upload unlawful, offensive, or discriminatory content;

infringe intellectual property rights;

use automated tools, scraping, or unauthorised data extraction.

TIC Recruitment reserves the right to suspend or terminate accounts at its discretion.

8. Intellectual Property & Use of Content

a) All intellectual property rights in the Platform, including but not limited to the website, software, databases, design, layout, text, graphics, branding, logos, and proprietary systems, are owned by or licensed to TIC Recruitment.

b) Candidates retain ownership of all personal content they upload to the Platform, including CVs, profiles, qualifications, references, and supporting documents.

c) By uploading content to the Platform, Candidates grant TIC Recruitment a non-exclusive, royalty-free, worldwide licence to store, process, reproduce, and share that content solely for recruitment, selection, safeguarding, and placement-related purposes.

d) Schools are granted a limited, non-transferable licence to view and use Candidate content only for the purposes of assessing suitability for a Role, conducting recruitment due diligence, and meeting safeguarding and child protection obligations.

e) Schools must not copy, download, retain, distribute, or use Candidate content outside the recruitment process, except where required by law or with the Candidate’s explicit consent.

f) Users must not scrape, reproduce, reverse engineer, or commercially exploit any part of the Platform or TIC Recruitment data without prior written consent.

9. Safeguarding & Child Protection Statement

TIC Recruitment is committed to safeguarding children and young people and supports international best practice in safer recruitment.

TIC Recruitment undertakes background and reference checks as part of its recruitment processes, appropriate to the role and jurisdiction.

Schools remain independently responsible for conducting their own safeguarding, police, regulatory, and child protection checks in accordance with local laws and policies.

No recruitment process can eliminate all risk, and TIC Recruitment does not warrant or guarantee the conduct or suitability of any Candidate.

Any safeguarding concerns raised in connection with a Candidate or School may result in suspension or removal from the Platform.

10. Privacy

TIC Recruitment complies with the New Zealand Privacy Act 2020 and applicable international privacy principles.

Users acknowledge and agree that personal information may be transferred and stored in jurisdictions outside New Zealand where required for platform operation, subject to appropriate safeguards.

10. Disclaimers

a) The Platform is provided on an “as is” and “as available” basis.

b) TIC Recruitment does not guarantee that:

a Candidate will secure employment; or

a School will successfully appoint a suitable Candidate.

c) TIC Recruitment is not responsible for the conduct, actions, or omissions of Candidates or Schools.

11. Limitation of Liability

To the maximum extent permitted by law, TIC Recruitment will not be liable for any indirect, incidental, consequential, or economic loss arising from use of the Platform.

Any liability, where it cannot be excluded, is limited to the fees paid to TIC Recruitment in the preceding six months.

12. Subscriptions, Fees & Refunds

a) TIC Recruitment may offer optional paid Subscriptions to Candidates and Schools. Subscription details, pricing, and features are displayed on the Platform.

b) Unless otherwise stated, Subscription fees are payable in advance.

c) Refunds: Subscription fees are non-refundable except where required by applicable consumer law. TIC Recruitment does not provide refunds for change of mind or early cancellation.

d) TIC Recruitment may suspend or terminate a Subscription for breach of these Terms.

13. Termination

TIC Recruitment may suspend or terminate access to the Platform at any time where these Terms are breached or where continued access poses a risk to safeguarding, reputation, or lawful operation.

Users may request account deactivation at any time.

14. Governing Law

These Terms are governed by and interpreted in accordance with the laws of New Zealand, and the parties submit to the exclusive jurisdiction of the New Zealand courts.
